1. Applicability
1.1 These Terms & Conditions apply to every offer made by Straight away Benelux B.V. and to all distance contracts concluded between Straight away Benelux B.V. and the consumer through the website www.straightawaydiet.com.
1.2 By placing an order, you acknowledge that you have read and accepted these Terms & Conditions.
1.3 Deviations from these Terms are only valid if agreed upon in writing by Straight away Benelux B.V.
2. Offer and prices
2.1 All offers on the website are non-binding. Straight away Benelux B.V. reserves the right to change prices and product details at any time.
2.2 All prices are displayed in euros, including VAT and excluding shipping costs, unless stated otherwise.
2.3 Obvious errors or mistakes in the offer are not binding on Straight away Benelux B.V.
3. Conclusion of the contract
3.1 A contract is formed when the consumer accepts an offer and Straight away Benelux B.V. confirms the order electronically.
3.2 Straight away Benelux B.V. reserves the right to refuse an order or request additional information if deemed necessary.
4. Payment
4.1 Payment must be made using one of the secure payment methods provided on the website.
4.2 The consumer must ensure that all payment details are accurate.
4.3 If payment is not received in time, Straight away Benelux B.V. may cancel the order.
5. Delivery and performance
5.1 Straight away Benelux B.V. takes great care when processing and shipping all orders.
5.2 Orders are delivered to the address provided by the consumer.
5.3 Delivery times indicated on the website are estimates; if delivery is delayed, the consumer will be notified as soon as possible.
5.4 The risk of damage or loss passes to the consumer upon receipt of the products.
6. Right of withdrawal (Cooling-off period)
6.1 Consumers have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.
6.2 After notifying Straight away Benelux B.V. of the withdrawal, consumers have an additional 14 days to return the product.
6.3 Upon withdrawal, the consumer will receive a full refund, excluding the original shipping costs. Return shipping costs are borne by the consumer unless otherwise stated.
6.4 Returned items should, if reasonably possible, be unused, unopened, and in their original condition and packaging.
7. Exceptions to the right of withdrawal
The right of withdrawal does not apply to:
a. Products whose seal has been broken (e.g., supplements, meal replacements, cosmetics, or other hygiene products);
b. Perishable products or those with a limited shelf life;
c. Products not suitable for return for health or hygiene reasons;
d. Products made to the consumer’s specifications or clearly personalized.
These exceptions comply with EU consumer protection laws.

9. Liability
9.1 Straight away Benelux B.V. is not liable for damages resulting from improper use of products or use contrary to provided instructions.
9.2 Liability is limited to the amount of the purchase price of the product concerned.
9.3 To the extent permitted by law, Straight away Benelux B.V. excludes all liability for indirect or consequential damages.
10. Force majeure
In the event of force majeure (including strikes, pandemics, government measures, natural disasters, or transportation disruptions), Straight away Benelux B.V. is not obligated to fulfill its obligations and may terminate the agreement without liability for any damages.
11. Intellectual property
All intellectual property rights related to the website, including but not limited to texts, images, logos, and designs, are owned by Straight away Benelux B.V. or its licensors.
It is not permitted to copy, reproduce, or distribute any material from the website without prior written permission.
12. Personal data and privacy
Straight away Benelux B.V. processes personal data in accordance with the General Data Protection Regulation (GDPR).
